1. Introduction
1.1 CarePlug is an online platform designed to connect patients with licensed healthcare professionals in Zimbabwe, offering a range of telemedicine services. These services include virtual consultations, electronic health records management, appointment scheduling, and secure messaging. By using CarePlug, patients can access healthcare from the comfort of their own homes.
1.2 By using CarePlug, you ("Patient" or "you") agree to these Terms and Conditions, which constitute a binding agreement between you and CarePlug. These Terms and Conditions outline the responsibilities and obligations of both parties.
1.3 CarePlug is only an intermediary service between the Account Holder and Healthcare Provider and should therefore not be regarded as a Healthcare Provider. The agreement between the Account Holder and CarePlug is therefore strictly a service agreement pertaining to the provision of a technical solution. Careplug is therefore not responsible for the nature or quality of medical examinations or other medical services provided within the context of a video meeting.
1.4 By registering an account on the website, in conformity with our prevailing guidelines, the Account Holder explicitly consents to be bound by the terms and conditions outlined below. This agreement constitutes a contractual undertaking between the Account Holder and CarePlug, governing the Account Holder's use of our services
1.5 Patients must satisfy two essential requirements to sign the agreement, register an Account, or log into the Application: (1) be at least eighteen (18) years old; and (2) have a valid national ID or identification document.
2. Definitions
2.1 "Services" refers to the comprehensive range of telemedicine services provided through the CarePlug platform. This includes:
- Telemedicine consultations with licensed healthcare professionals
- Electronic health records management
- Appointment scheduling
- Secure messaging
2.2 "Healthcare Provider" means licensed medical professionals registered with relevant Zimbabwean medical authorities (Medical and Dental Practitioners Council of Zimbabwe) and using the CarePlug platform.
3. Patient Responsibilities
3.1 To ensure effective care, patients must provide accurate, complete, and up-to-date personal and medical information. This includes:
- Medical history
- Allergies
- Medications
- Other relevant health information
3.2 Patients must comply with applicable Zimbabwean laws, regulations, and guidelines related to healthcare and telemedicine.
3.3 Patients are expected to respect Healthcare Providers' time, expertise, and professional boundaries.
4. Payment Terms
4.1 The App provides a comprehensive list of prices for video meetings with Healthcare Providers and any additional costs for other services, which can be accessed prior to scheduling a meeting or accessing the service.
4.2 Payment for a video meeting is required prior to its commencement. The meeting will not commence until payment has been successfully processed. Payment for Services is required at the time of scheduling. Patients must use accepted payment methods.
4.3 CarePlug accepts various payment methods, including:
- EcoCash ZWG
- EcoCash USD
5. CarePlug's Responsibility
5.1 CarePlug is committed to ensuring the App's availability and proper functioning within the limitations outlined below
5.2 Availability and Data Storage: CarePlug ensures the App is available for use and securely stores Account Holder information and symptoms submitted by Account Holders or Healthcare Providers.
5.3 Compliance with Laws: CarePlug guarantees compliance with electronic commerce and protection of personal sensitive information but does not take responsibility for data loss.
5.4 Content Liability: CarePlug disclaims responsibility for linked content.
5.5 App Uptime: CarePlug strives for high App availability, allowing Account Holders to access their accounts and book appointments at any time.
5.6 Disruption Exceptions: CarePlug is not liable for disruptions caused by:
- Account Holder hardware/software issues
- Account Holder responsibility
- Viruses or security threats
- Force majeure
5.7 Service Scope: CarePlug is responsible for App operation, including video meetings and information storage, but not for healthcare advice or information provided by Healthcare Providers.
5.8 Error Reporting: Report disruptions/errors to customer service (+263 77 939 4927, admin@careplug.org available 9am-5pm, daily)
5.9 Limitation of Liability: CarePlug is not accountable for indirect damages, consequential losses, or expected savings.
6. Confidentiality and Security
6.1 CarePlug prioritizes patient data protection, adhering to Zimbabwean data protection laws (Data Protection Act) and international best practices.
6.2 Patients must maintain confidentiality of Healthcare Providers' advice and not share it with unauthorized parties.
7. Disclaimers and Limitations
7.1 CarePlug is not liable for damages arising from Services, including:
- Technical issues or connectivity problems
- Healthcare Provider errors or omissions
- Patient non-compliance with Healthcare Provider advice
7.2 Healthcare Providers are independent contractors, not CarePlug employees. CarePlug does not guarantee the quality or accuracy of their services.
8. Termination
8.1 CarePlug may terminate or suspend Patient accounts for non-compliance with these Terms and Conditions or applicable laws.
8.2 Patients may terminate their account at any time, provided that any outstanding fees are paid.
9. Governing Law
9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Zimbabwe.
9.2 Any disputes arising from these Terms and Conditions shall be resolved through arbitration in Harare, Zimbabwe, in accordance with the Arbitration Act.
10. Changes to Terms and Conditions
10.1 CarePlug reserves the right to update these Terms and Conditions at any time without notice.
10.2 Continued use of CarePlug constitutes acceptance of updated Terms and Conditions.
